By accessing or using any of our services, you confirm that you have read, understood, and agreed to abide by these Terms of Service, along with our Privacy Policy. If you do not agree, please refrain from using our services.
1.1 These Terms constitute a binding contract between you and Ishqmet. In this document, references to "we", "our", or "us" mean the Ishqmet App. References to "you" or "user" refer to anyone accessing or using our services. These Terms apply to all versions of the product and may be amended periodically without prior notice.
1.2 This document, also known as the "Terms of Use" or simply the "Terms," is a legally binding agreement between you (the "User") and the Ishqmet application (the "App"). By accessing or using the App, you agree to these Terms, which govern your rights and responsibilities while using the service. If you do not agree with any part of these Terms, you must not use the App.
Use of the Ishqmet services is strictly limited to individuals who are 18 years of age or older. By creating an account or using the Services, you confirm and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.Ishqmet does not knowingly collect or allow the use of its platform by anyone under the age of 18. If it is discovered or suspected that an account has been created by someone who does not meet this age requirement, we reserve the right to suspend or permanently delete the account without prior notice.
To access and use the features of Ishqmet, you must first create an account by registering with accurate and current login information, such as a valid email address and a secure password. You agree to provide truthful, complete, and up-to-date information during the registration process and to keep your account details current at all times.You are solely responsible for maintaining the confidentiality and security of your login credentials and for all activities that occur under your account. Ishqmet will not be held liable for any loss or damage resulting from unauthorized access to your account due to your failure to safeguard your login information.
4.1 "Content" includes but is not limited to text, audio, photos, videos, graphics, posts, messages, and other material you upload or transmit via the app. You are solely responsible for any Content you share, and you affirm that you have the necessary rights or licenses to use and distribute such materials.
4.2 We do not control the posted Content and, as such, we do not control its accuracy, integrity, quality or any other aspect. Under no circumstances are we liable to you or to any third party in any way for any Content, including but not limited to any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content.
4.3 You hereby grant us a perpetual, assignable, world-wide, royalty free, sub-licensable and non-exclusive license to use, distribute, reproduce, record, modify, adapt, process, combine, synchronize, create derivative works from, publish, publicly perform and publicly display such Content (including your user name and likeness) on our owned & operated applications (“Apps”)，and elsewhere in any and all media or distribution methods (now known or later developed) for any promotional and other commercial purpose, whether by us, our partners or other third parties, in our sole discretion.
4.4 We may use your feedback, comments and suggestions without any obligation to compensate you for them. We may continue to use and make available any and all Content and we will continue to have all of these rights even if your account is terminated.
5.1 While using our services, you agree not to engage in or promote behavior that is:
(a) create, upload, transmit, distribute, or store any content that is inaccurate, unlawful, infringing, defamatory, obscene, pornographic, child sexual exploitation and abuse content ,invasive of privacy or publicity rights, harassing, threatening, abusive, inflammatory, or otherwise objectionable;
(b) impersonate any person or entity, falsely claim an affiliation with any person or entity, or access Ishqmet accounts of others without permission, forge another person’s identity, or content of information transmitted via the Services, or perform any other similar fraudulent activity;
(c) defame, harass, abuse, threaten or defraud users of Ishqmet, or collect, or attempt to collect, personal information about users or third parties without their consent;
(d) remove, circumvent, disable, damage or otherwise interfere with security-related features of the Services or User Content, features that prevent or restrict use or copying of any content accessible through the Services, features that enforce limitations on the use of the Services or User Content, or delete the copyright or other proprietary rights notices on the Services or User Content;
(e) reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Services or any part thereof;
(f) modify, adapt, translate or create derivative works based upon the Services or any part thereof;
(g) interfere with or damage operation of the Services or any user’s enjoyment of them, by any means, including uploading or otherwise disseminating viruses, adware, spyware, worms, or other malicious code;
(h) interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services; use the Services in any manner that could interfere with, disrupt, negatively affect or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden or impair the functioning of the Services in any manner;
(i) attempt to circumvent any content filtering techniques we employ, or attempt to access any service or area of the Services that you are not authorized to access;
(j) use the Services for any illegal purpose, or in violation of any local, state, national, or international law or regulation, including, without limitation, laws governing intellectual property and other proprietary rights, data protection and privacy.
6.1 Ishqmet may offer certain virtual items, features, or enhancements available through one-time in-app purchases (“Paid Services”). These purchases are processed securely through third-party platforms such as the Apple App Store or Google Play Store. Ishqmet does not collect or store your payment details directly.
6.2 By completing an in-app purchase, you agree to the pricing and terms presented at the time of the transaction. All purchases are final and non-refundable, except where required by applicable law or as permitted by the policies of the app store used.Misuse or fraudulent activity related to in-app purchases may result in suspension or termination of your account.
7.1 Subject to the terms herein, the Company grants you a revocable, limited, non-exclusive, non-transferable, non-assignable, and non-sublicensable license for non-commercial purposes, to install the App and use the Services solely for the purposes set forth herein (“License”). Except as expressly stated under the term, we or our licensor retain all rights, title ownership, and interest in and to the Services, copyrights and trademarks, images, logos product names, and trade names, to the fullest extent possible under applicable law. We or our licensor reserve all rights in and to the Services which are not expressly granted herein.
7.2 You acknowledge that all right and interest in the App’s trademarks, service marks, components, code, protocols, software and documentation as well as any derivatives thereof or improvements and modifications (excluding the Third-Party Management Tools), are our property or the property of our licensors, and are protected by international copyright, trademarks, patents and other proprietary rights and laws relating to trade secrets, recognized in any country or jurisdiction worldwide, including, without limitation, moral or similar rights. You may not use, delete, alter, or remove any copyright, trademark, or other proprietary rights notice placed in the App. Except as expressly granted herein, we retain all right, title and interest in and to our Service, as well as any content provided or made available in connection with the Service (excluding the Third-Party Advertisement).
8.1 Ishqmet respects the intellectual property of others, and we ask our users to do the same. If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify Ishqmet of your infringement claim in accordance with the procedure set forth below.
8.2 Ishqmet will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws with respect to any alleged or actual infringement. A written notification of claimed copyright infringement should be sent to vocafamily378@gmail.com.
8.3 For your notification to be valid, it needs to be in writing and include:
(a) your electronic or physical signature as the person qualified to represent the copyright or other intellectual property owner;
(b) a detailed description of the copyrighted work or other intellectual property you believe has been violated;
(c) a clear guide to where this material is located on our site;
(d) your contact details, including address, phone number, and email;
(e) a statement by you asserting your honest belief that the use in question isn't sanctioned by the copyright or intellectual property owner, its agent, or the law; and
(f) a statement by you, under penalty of perjury, affirming the accuracy of your notice's information and your authorization to act on behalf of the copyright or intellectual property owner.
8.4 Ishqmet adheres to the DMCA and other relevant laws and will, when deemed necessary and at its sole discretion, terminate the accounts of users who repeatedly infringe. Ishqmet can also limit access to the Services and/or terminate the accounts of any users who violate others' intellectual property rights, regardless of whether repeat infringement is involved.
9.1 Our platform may link to or incorporate third-party websites, services, or advertisements. We are not responsible for the content, accuracy, or functionality of these external services, nor any damages resulting from their use.
9.2 All interactions with third-party advertisers or services are strictly between you and the respective parties. We are not responsible or liable to you or to any third party for any loss or damage of any sort caused or alleged to be caused in connection with any such dealings or as the result of the presence of such advertisers on Ishqmet. We will not be liable to you or to any third party for any failure by an advertiser to provide any service or product you ordered from it.
10.1 Ishqmet maintains a strict zero-tolerance policy toward child sexual abuse and exploitation in any form. This includes, but is not limited to, the creation, possession, distribution, or promotion of child sexual abuse material (CSAM), grooming of minors, or any attempt to exploit or endanger children through the platform.
10.2 Any user found to be engaging in, facilitating, or encouraging such behavior will have their account permanently terminated without notice. In addition, Ishqmet will report all suspected violations to the appropriate law enforcement authorities and fully cooperate with any investigation.
10.3 We actively monitor our platform using a combination of automated tools and human review to detect and prevent harmful content or behavior. By using Ishqmet, you agree to comply with this policy and understand that any involvement in CSAE activities will result in immediate and irreversible consequences, both legally and on the platform.
11.1 Your privacy is important to us. Ishqmet is committed to protecting your personal information and ensuring transparency about how your data is collected, used, stored, and shared. By using our Services, you acknowledge and agree that your information will be handled in accordance with our Privacy Policy.
11.2 Our Privacy Policy provides detailed information about the types of data we collect, including personal details, device information, usage data, and any content you may voluntarily share. It also explains how we use this data to operate, maintain, and improve our services, ensure user safety, and comply with legal obligations.We encourage all users to review the Ishqmet Privacy Policy carefully to understand their rights and the steps we take to protect your information.
12.1 You use Ishqmet at your sole risk. We provide Ishqmet on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. No advice or information, whether oral or written, obtained by you from or through us shall create any warranty not expressly stated in the TOS.
12.2 We do not guarantee that Ishqmet will always be safe, secure or error-free or that Ishqmet will always function without disruptions, delays or imperfections. We make no warranty that (a) Ishqmet will meet your requirements, (b) Ishqmet will be uninterrupted, timely, secure, or error-free, (c) the results that may be obtained from your use of Ishqmet will be accurate or reliable, (d) the quality of any products, services, information, or other material purchased or obtained through Ishqmet will meet your expectations, and (e) any errors in the software will be corrected.
12.3 Any content, information, or material downloaded or otherwise obtained through Ishqmet is done at your own discretion and risk. You will be solely responsible for any damage to your or another’s device or loss of data or any other damage or loss that results, directly or indirectly, from the download of any such content, information or material.
13.1 We are not responsible for the actions, content, information, or data of third parties, and you release us, our subsidiaries, affiliates, and each of our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any Ishqmet users or other third parties.
13.2 You expressly agree that we shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangibles (even if we have been advised of the possibility of such damages), and including without limitation resulting from: (a) the use or the inability to use Ishqmet; (b) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from Ishqmet; (c) unauthorized disclosure, access to or alteration of your content, transmissions or data; (d) statements or conduct of any user or third party.
You agree to defend, indemnify, and hold harmless Ishqmet, along with its parent company, affiliates, officers, directors, employees, agents, licensors, and partners, from and against any and all claims, demands, damages, losses, liabilities, costs, or expenses, including reasonable legal fees, that arise from or relate to your use of the Services, the content you post or share through the platform, your violation of these Terms, or your infringement of any third party’s rights, including intellectual property, privacy, or data protection rights. This obligation will continue to apply even after you stop using the Services or your account is terminated.Ishqmet reserves the right to take over the defense of any claim subject to indemnification, at your expense, and you agree to fully cooperate in such a defense.
15.1 Ishqmet reserves the right to modify, update, or terminate these Terms of Service, as well as the features and functionality of the Service, at any time and at our sole discretion. Such changes may be made to reflect updates in our business practices, comply with legal requirements, or improve user experience.
15.2 Any changes to these Terms will become effective immediately upon being posted within the app or on our official website, unless a later effective date is specified. We are not obligated to provide individual notice for each update; therefore, it is your responsibility to review the Terms regularly to stay informed of any revisions.
15.3 By continuing to access or use Ishqmet after any modifications to the Terms have been posted, you are indicating your acceptance of the updated Terms. If you do not agree to the revised Terms, you must discontinue use of the Service immediately.
